Diddy has initiated a fresh legal bid for his release, arguing that his four-year prison sentence is excessively severe.

The music mogul, known as the head of Bad Boy Entertainment, was handed a 50-month prison term last year after being convicted on two charges of transporting individuals for prostitution under the Mann Act. However, he was acquitted of more serious allegations, including sex trafficking and racketeering.

In a recent appeal filed on March 13, Diddy’s legal team denounced the sentence as a “perversion of justice.” They urged either an immediate release with a judgment of acquittal or a court order to annul the sentence and initiate a resentencing process, as reported by TMZ.

The appeal criticizes Judge Arun Subramanian, who oversaw the trial, for applying “acquitted conduct” sentencing. This controversial practice involves imposing stricter penalties based on allegations that were dismissed by the jury.

Diddy’s attorneys had initially sought a 14-month sentence, arguing that the imposed 50-month term indirectly penalizes him for charges he was cleared of. They emphasized that the sentence far exceeds the average for Mann Act-related cases, being nearly four times the typical duration.

The legal filing questions the fairness of the justice system, stating: “What is the point of a jury trial if your sentence is driven by what you were acquitted of doing?”

The U.S. Court of Appeals for the Second Circuit will now review these arguments, with oral proceedings scheduled for April 9.

Currently, Diddy is projected to complete his sentence and be released on April 25, 2028, according to the Federal Bureau of Prisons.

The 56-year-old is serving his term at FCI Fort Dix, a low-security federal correctional facility in New Jersey that he had personally requested for his incarceration.
