Diddy‘s legal team is pushing for his release from prison, claiming that his so-called “freak-offs” should be regarded as amateur adult content.
On Thursday (April 9), the United States Court of Appeals reviewed the latest motion seeking the release of the Bad Boy Entertainment founder.
According to a report from TMZ, Diddy’s attorneys argued that his activities did not violate any laws and should simply be classified as amateur pornography.
“Freak-offs and hotel nights were highly choreographed sexual performances involving the use of costumes, role play, and staged lighting which were filmed so Combs and his girlfriends could watch this amateur pornography later,” they said.
“Pornography production and viewing of this sort is protected by the First Amendment and thus cannot constitutionally be prosecuted.”
During the hearing, Diddy’s legal team highlighted Cassie‘s history of drug use, a subject that had been excluded from evidence during his trial.
In July, Diddy was convicted on two counts of violating the Mann Act, which pertains to the transportation of individuals for prostitution. His lawyers argue that his sentence was disproportionately severe, noting that the typical penalty for such charges is about 15 months.
Diddy has already spent 19 months incarcerated. It remains uncertain when a decision on his appeal will be announced.
Initially, Diddy’s release from prison was scheduled for June 4, 2028. However, in March, his sentence was reduced by 40 days. As it stands, his new release date is set for April 25, 2028.
